Overview and Outcomes.
Who It's For
Leaders and managers handling discipline, grievance and restructuring
Overview
This half-day programme focuses on the people matters most likely to end in a tribunal, and most likely to damage trust if handled badly. It covers conduct and discipline under the Acas Code and the Burchell test, grievances, bullying and mediation, and whistleblowing and speaking up. It then turns to dismissal, redundancy, fire and rehire and TUPE, working with trade unions and the Welsh social partnership duty, and fair investigations and records. A capstone reads Tesco v USDAW, Birmingham City Council and an illustrative Welsh council through several lenses at once.
Aims
This programme aims to develop leaders who stay fair, steady and lawful when people matters become difficult: following a fair process in discipline and grievance, treating concerns raised as information, consulting genuinely on change, and keeping the evidence that shows decisions were reasonable.
In summary, you will be able to:
- Apply the Acas Code, the Burchell test and principles of proportionality to disciplinary, grievance and bullying cases.
- Plan dismissals, redundancies and changes to terms that meet legal requirements, involve trade unions and consult while the answer can still move.
- Lead investigations and respond to whistleblowing concerns in ways that protect people who speak up and produce balanced, defensible records.
What you'll develop
Across this Explore, you will develop the ability to:
- Plan a fair disciplinary process in line with the Acas Code, from investigation and the right to be accompanied through to decision and appeal.
- Plan the handling of a grievance in line with the Acas Code, from early listening to a reasoned decision and appeal.
- Identify the five potentially fair reasons for dismissal and explain how fair reason, fair process and fair decision are tested together.
- Plan a fair redundancy process, from business case and consultation through pool, criteria, alternatives, notice and appeal.
- Plan a fair investigation, from assessment and terms of reference to an independent investigator, evidence gathering and a decision on the balance of probabilities.
- Explain how Tesco Stores v USDAW shows that a promise in a contract can be enforced, and how the law on fire and rehire is changing.
