About this course

Overview and Outcomes.

Who It's For

Senior leaders and managers taking serious people decisions such as dismissal and restructuring

Overview

Some people decisions carry the highest stakes for individuals, organisations and trust. This programme covers whistleblowing law and a speaking up culture, with lessons from Mid Staffordshire and the Francis review, and dismissal done fairly through the band of reasonable responses and Polkey. It examines redundancy, collective consultation, fire and rehire after Tesco v USDAW and TUPE, read through Colquitt's justice dimensions and Rousseau's psychological contract, and working with trade unions under the Welsh social partnership duty. It closes with fair investigations and records, and a capstone drawing these threads together.

Aims

This programme aims to develop leaders who can take the most serious people decisions lawfully and with dignity: welcoming concerns as information, dismissing and restructuring fairly, consulting while the answer can still move, and building the evidence and records that show a fair process was followed.

In summary, you will be able to:

  1. Explain whistleblowing protections and the requirements for a fair dismissal, including the potentially fair reasons and the band of reasonable responses.
  2. Plan restructuring, redundancy or TUPE transfers with genuine consultation that meets the Gunning principles and protects trust and the psychological contract.
  3. Lead a fair workplace investigation, from interviewing witnesses to writing a balanced report, and keep records that will withstand scrutiny.

What you'll develop

Through this Focus course, you will build the ability to:

  1. Identify when a concern is likely to be a protected disclosure, including the reasonable belief and public interest tests and the routes for disclosure.
  2. Identify the five potentially fair reasons for dismissal and explain how fair reason, fair process and fair decision are tested together.
  3. Plan a fair redundancy process, from business case and consultation through pool, criteria, alternatives, notice and appeal.
  4. Explain what union recognition means in practice, including collective bargaining, facility time and consultation duties.
  5. Plan a fair investigation, from assessment and terms of reference to an independent investigator, evidence gathering and a decision on the balance of probabilities.
  6. Explain how Tesco Stores v USDAW shows that a promise in a contract can be enforced, and how the law on fire and rehire is changing.
